A binding limitation on how property may be used, recorded in the CC&Rs and enforceable by the HOA.
A restrictive covenant is a recorded limitation on the use of property — the individual restrictions that make up much of the CC&Rs. Examples include limits on building types, exterior appearance, rentals, or business use.
Because covenants run with the land, they bind all present and future owners and are enforceable by the association. To stay enforceable, they must be applied consistently and not conflict with the law (for instance, covenants that discriminate are unenforceable).
