The CC&Rs are the foundational legal document of an HOA. Recorded against the property, they run with the land — meaning they bind every current and future owner automatically.
What they contain
- Covenants — promises owners make, such as paying assessments.
- Conditions — requirements tied to ownership.
- Restrictions — limits on how property can be used, from paint colors to rentals to pets.
Because they're recorded and run with the land, CC&Rs are harder to change than bylaws or rules and usually require a supermajority owner vote to amend. They are the primary source of an HOA's authority to enforce standards.
